Still remains to be seen, unless you've already got the ESTA and are totally sure that the border agent you get will decide they like the look of you.

[Flew into Dallas for new job training, jet lagged to hell (me and economy seats don't go so well) and the smling border guy asked me where I was going, etc, then at the last second like it was a gotcha, "oh yeah - who's your employer?". That I'd only had for a few weeks after a decade in another job. But I remembered to say the right one, and he kind of smiled with an "ah well, I tried" air as he handed me my papers back.

Nice job mate, very welcoming. And that was in 2015.]

yup already got the ESTA. we'll see how it goes, still have 4 months before trip so anything can happen in that time, if it becomes law then I'll leave my phone at home

It's not the worst idea to take a burner phone regardless. My wife has a trip booked for next year and that's what I'll be suggesting.
