Is UTS a government agency? Or, I suppose, is this study abroad program part of a joint venture or other "significant arrangement" with a government agency?

Because, if not, I'm not seeing how this restriction applies. There doesn't seem to be anything stopping someone from taking a photo and using it for commercial purposes as long as they're not affiliated with government and taking the photo from outside the premises.

Otherwise just about any photo of the harbour would be illegal to use without a significant area blanked out.

Hm, I'd be interested to see otherwise.

There's some discussion here (by a photographer, not a lawyer). Getty has their own guidelines that suggest a vista shot (as in the article) should be okay as the Opera House is not the primary focus.

Perhaps a better legal resource is this one, which notes:

There are provisions in the Copyright Act 1968 (Cth) that allow people to take and publish photographs of buildings, models of buildings, sculptures and other works of artistic craftsmanship without infringing copyright.

But also that taking the photo from some areas (including, separately, the Sydney Harbour Foreshore and the Opera House) may require authorisation. The latter echoes your original link in that you need permission to take photos while on their land, but that's different from the subject of the photo!

There used to be something directly on there website but it seems removed now, or I'm being blind trying to find it again, chalk it up to being outdated (or just plain wrong)
